BISTONE MUNICIPAL WATER SUPPLY DISTRICT
BOND COUNSEL, ENGINEER, AND FINANCIAL ADVISOR
REQUEST FOR QUALIFICATIONS
Bistone Municipal Water Supply District (BMWSD) requests the submission of qualifications
statements, which will lead to the possible award of separate contracts to provide Bond Counsel,
Engineer, and Financial Advisor services for a project involving transmission main replacement and
elevated or pressure tanks. The BMWSD is anticipating funding through the Texas Water Development
Board (TWDB) under the Drinking Water State Revolving Fund (DWSRF) loan program.
Scope of Work
The services to be obtained for the Bond Counsel generally requires the following: Preparation of
documentation pursuant to which debt obligations will be issued; review of applicable law and legal
issues relating to the structure of the debt obligations; preparation of documentation and coordination of
sale of the debt obligations; and related services.
The services to be obtained for the Engineer generally requires the following: Comprehensive
engineering, planning, geotechnical, surveying, environmental, and material testing services related to
the design and construction administration of the project.
The services to be obtained for the Financial Advisor generally requires the following: Strategic
financial planning, analysis of market conditions, recommended investments of bond proceeds, and
recommendations for financing.
Guidelines for Content of Qualification Statements
DO NOT INCLUDE COST INFORMATION with the qualification statements. Responses that include
cost or pricing information will be rejected and will not be considered.
Detailed instructions on preparation of the qualifications statement must be obtained from BMWSD.

should be requested as soon as possible in order to allow time to prepare the document and comply with
the procedures.
Submittal Deadline
Qualifications statement must be received by: Friday, August 22, 2025, 2:00PM CST. Additional
submittal requirements are provided in the full Request for Qualifications.
Minimum Qualifications and Selection Criteria
The BMWSD will evaluate the proposals to determine which firm has the best qualifications.
Contract Terms and Negotiation Schedule
The consultants for Bond Counsel, Engineer, and Financial Advisor services are expected to negotiate
an agreement for services which is acceptable to the BMWSD. If an acceptable contract cannot be
negotiated, the BMWSD may formally end negotiations and begin negotiating with the next highest
qualified person or firm.
Contracts are contingent upon release of funds from the TWDB. Any contract awarded under the RFQ
are expected to be funded in part by a loan from the TWDB. Neither the State of Texas nor any of its
departments, agencies, or employees are or will be a party to the RFQs, or any resulting contract. These
RFQs are issued in accordance with Section 2254 of the Texas Government Code (Professional Services
Act) and Title 40 Code of Federal Regulations, Part 31 (Uniform Administrative Requirements for
Grants and Cooperative Agreements to State and Local Governments).
Disadvantaged Business Enterprise Program
This contract is subject to the Environmental Protection Agency’s (EPA) Disadvantaged Business
Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of
Minority and Women-owned Business Enterprise (M/WBE) firms. EPA rules require that applicants and
prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and
procurements to M/WBEs through demonstration of the six affirmative steps. For more details of the

This contract includes goals for Minority and Women’s Business Enterprise participation. The
Environmental Protection Agency (EPA) has approved the following Minority Business Enterprise
(MBE) & Women Business Enterprise (WBE) fair share goals for the TWDB State Revolving Fund
programs effective 04/01/2024 till 05/01/2027. EPA policy does NOT mandate that the fair share goals
be achieved but does mandate that a documented good faith effort be made toward achieving the goals.
